Enforcing copyright through administrative proceedings: what can the EU learn from national experiences?

This Digital Forum seminar provides an overview of how public authorities in France, Spain, the UK, and Italy are implementing administrative remedies that are supplementary to, and distinct from, those granted by judicial bodies. The seminar aims to assess whether administrative proceedings created by national regulations for the purpose of reducing online piracy might constitute a model to follow at EU level or they are likely to be maintained merely at a local level.  Representatives of national authorities, copyright experts and stakeholders will discuss openly the effects and the achievements of these remedies and proceedings. Some of the questions to be addressed include:

  • How will the EU target the problem of online ‘piracy’ in the near future, especially in the policy context of a ‘Digital Single Market’ for creative content?
  • How could uniformity be ensured in Europe with regard to copyright enforcement measures targeted at both online intermediaries and direct infringers?
  • ?Do existing measures and procedures ensure a fair balance between copyright enforcement and the protection of other fundamental rights, as required by the case law of the Court of Justice of the EU?
