The General Data Protection Regulation - Issues for the Trilogue

This Digital Forum seminar, in cooperation with TechUK and the Coalition for the Digital Economy (COADEC), will discuss the General Data Protection Regulation (GDPR) and the issues likely to be discussed in the trilogue. The seminar will also highlight issues faced by start-ups and SMEs concerning data protection.

The proposed GDPR aims at setting high data-protection standards, harmonised across the 28 member states and appropriate for the digital economy. Unified regulation under the Digital Single Market will help data controllers and users to understand their rights and obligations, and will prevent companies from circumventing the rules by locating their main centre of operation in a country with weak data-protection standards. In addition, the GDPR will mean that EU data protection law is valid whenever the European market is targeted – whether from within or outside of the EU.

With the proposal about to enter trilogue negotiations, what will be the main issues to be discussed? Likely to be on the agenda are:

  • The right to be forgotten
  • Informed consent - "ambiguous" vs. "explicit”
  • The right to information and transparency
  • Joint liability for controllers and processors
  • The risk-based approach
  • Profiling and legitimate interest
  • Compatible and incompatible purposes for data processing
  • The “One Stop Shop"
  • Transfer of data to outside the EU
  • Sanctions for illegal data processing
